CHARGE OF KILLING GOAT WITH INTENT TO STEAL

John Gray (50) and William Gribble (22) appeared before Mr. A. R. Perry, S.M., in the Police Court this afternoon charged that they did, in company on June 22 wilfully kill one goat, valued at £3, the property of Walter Cook, with intent to steal the carcase.

Inspector Dimond stated that the accused had been arrested at about 3.30 o'clock, and that he was not prepared to go on with the case.

He had no objection to bail if a remand was granted till Monday. The carcase had been recovered.

The magistrate remanded accused till Monday. Bail was allowed at self in £10, with one surety for a like amount.

After it had been explained that both men had families the magistrate decided to allow the men out on their own recognisances in the sum of £10 each.

Goat trial continued.

IN POSSESSION OF A GOAT SUSPECTED OF BEING STOLEN

TWO MEN CHARGED FINED £1 3/ EACH

In the Police Court today, before Mr. A. R Perry, S.M John Gray (50) and William Gribble (22) were charged that on June 25th they did have in their possession the carcase of a goat reasonably suspected of being stolen. Mr. W. P. Blackmore appeared for the accused.

Constable. T. W. Fisher deposed: that at the cemetery on June 25 he met a man named Cook and three boys, and was told something, as a consequence of which he went to the house of the accused.

Gribble was washing something in a bucket, and in reply to witness said that it was goat he was washing.

Gray said that the goat was his property, and that he had killed it on the common that morning.

The skin of the goat was in the yard, and in reply to a question put by witness Gray said that the head of the goat was boiling in the pot.

Mrs. Gray denied the statement, and said that the dog had taken it.

Cook, who was present, looked at the skin, and identified it as one from a goat owned by him.

Gray said: "No, it is mine" how can you swear that it is yours?"

Cook replied: “I know it, because it is a half-bred Angora, and is the only one I had in the flock."

Cook then gave both the accused in charge.

Gray admitted that he had shot the goat.

Watson Cook deposed that he owned 10 goats, which were agisting about three miles from Broken Hill in the direction of the Tramway Tank.

His goats were the only ones on the common. He identified the skin as his property by a grease mark which was the result of the animal rubbing against the axle of a buggy.

There was an identification mark on the horn of the goat, but the horns could not be found. All his goats had black marks on them.

The goat was a pet, and had been christened "Flossie" by his wife because of the flossy hair on the skin.

To Mr. Blackmore: No goats had ever been mixed up with his flock.

Walter Cocks (15) deposed that on Friday: he saw Cook go past with a herd of goats and leave them on the common. later witness saw Gribble and Gray go past the sale yards in a cart. They fired two shots. The men then got out of the cart and picked up something near the railway fence. A mob of goats raced over the railway line when the shots were fired. The men then drove, back towards Broken Hill. Witness inspected the spot and saw blood on the ground near the fence, and further spots of blood leading to where the cart had stood.

To Mr. Blackmore: He could not say whether Gray owned the goats.

William Cunningham (14) gave similar evidence. He added that he noticed another herd of goats back, towards the cemetery.

Louisa Cook deposed that: she was the wife of Watson Cook. She identified the skin as coming from "Flossie," their pet goat.

The accused at this stage pleaded not guilty and gave evidence in defence.

John Gray deposed that: he owned about 18 or 20 goats. They were a mixed lot, some being Angoras and others straight, horns. The carcase and skin produced were his property. On Friday last he went out in his own vehicle for the purpose of shooting one of his own goats. They shot the animal near the railway line. The shot was fired by Gribble. He did not see other goats near his flock.

To Inspector Dimond: The evidence given by the two boys was untrue. He could not say whether the ground near where the goat was shot was kicked over to cover the blood. He could not produce the horns, from the goat.

William Gribble deposed that: he shot the goat acting under instructions from Gray. Gray picked out the goat for him to shoot. Two shots were fired. He kicked some sand over the blood near the fence but never attempted to cover the blood which came from the animal while he carried it from the fence to the cart. He was certain that the goat shot was one owned by Gray. He had looked for the horns but had failed to locate them.

Inspector Dimond: The goat skin was covered with black which was caused by the animal rubbing against a pot. All goats did not have black from the pots on their skins.

The Magistrate: There is not the shadow of a doubt that the goat shot belonged to Cook. The accused are fined £1 each, and ordered to pay 8/ court costs each in default, three days imprisonment. One week is allowed in which to pay the fine.
